YouTube won summary judgement motion against Viacom. This means that the DMCA safe harbors for ISPs have passed judicial review. That would mean a big reduction in legal risk for internet developers whose products are able to implement notice-and-takedown. Just be very careful to get the legal details right and your startup will be on predictable footing.
But caveat emptor. This is just one bit of data in a very complex landscape.
It sure adds a little glimpse of hope for all those strong believers of the DMCA…. but, with every step forward, there are steps that bring us back to the harsh reality of corporate america.

The way that EFF and other digital politics projects see themselves is a nop as far as people in the entertainment industry go. You couldn’t explain it any more than you could explain snow to a bowling ball. People perceive it as completely out there. They have never heard of such a thing.
